Unfortunately, Belgian legislation does not state anything regarding paying for extra hours. So if your weekly hours exceed the maximum number of hours, the following rules apply:
- If you have worked for 39 hours a week for a whole year for the same employer, you will receive 6 unpaid compensatory days.
- If you have worked for 40 hours a week for a whole year for the same employer, you will receive 12 unpaid compensatory days.
- You may never exceed the maximum of 40 hours a week.
If you haven’t worked for a whole year for the same employer, you will receive one or two unpaid compensatory days for each 2 month period you have worked.
It is also important to know that you are allowed to work only one Sunday in every four, and if you always work on Sundays, you must be given a day off in compensation within the six days.
